Terms of Service
1. Introduction
Welcome to tattap ("we," "us," or "our"). tattap is a marketplace platform that connects tattoo artists with individuals seeking tattoo services. By accessing or using the tattap mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.
2. Eligibility
You must be at least 18 years of age to use tattap. By creating an account, you represent and warrant that:
- You are at least 18 years old
- You have the legal capacity to enter into a binding contract
- All information you provide is accurate and complete
3. Service Description
tattap is a marketplace platform that:
- Allows tattoo artists to post available flash designs and appointment availability
- Enables users to browse designs and request appointments with artists
- Facilitates communication and booking coordination between users and artists
tattap is NOT: a tattoo studio or service provider, an employer or agent of the artists using the platform, or responsible for the quality, safety, or legality of tattoo services provided.
4. Beta Testing Period
tattap is currently in beta testing. During this period:
- No deposits or cancellation fees are required to book appointments
- Features and functionality may change without notice
- Service interruptions may occur
- User feedback is encouraged to improve the platform
When tattap transitions to full release, artists will be able to configure their own deposit requirements, cancellation policies, and associated fees.
5. User Responsibilities
As a user of tattap, you agree to:
- Provide accurate and truthful information in your profile
- Honor appointments you book through the platform
- Accept the design and price as stated in the app for your appointment
- Cancel appointments as early as possible (ideally 24 hours in advance) if you cannot attend
- Comply with all applicable laws, regulations, and local studio policies
- Treat artists and other users with respect
6. Artist Responsibilities
Artists using tattap agree to:
- Provide accurate information about their services, availability, and pricing
- Maintain all required licenses, permits, and insurance as required by law
- Set and communicate their own policies regarding deposits, cancellations, health screenings, and service terms
- Comply with all applicable health, safety, and legal requirements
- Honor confirmed appointments or provide reasonable notice of cancellation
Artists are independent contractors, not employees or agents of tattap. Each artist is solely responsible for: the quality and safety of their work, compliance with local health and safety regulations, client screening, consent, and aftercare, tax obligations and business licensing, and professional liability and insurance.
7. Bookings and Cancellations
Booking Process
- Users may request appointments by selecting an available time slot from an artist's calendar
- Bookings are subject to artist confirmation
- tattap facilitates the booking request but does not guarantee acceptance
Cancellations
- Users may cancel bookings through the App
- We encourage users to cancel at least 24 hours in advance when possible
- During beta testing, no cancellation fees or deposits are charged through the platform
- When tattap transitions to full release, artists will set their own cancellation policies, fees, and deposit requirements
8. Limitation of Liability
IMPORTANT: tattap is a marketplace platform only. We do not provide tattoo services.
To the fullest extent permitted by law:
- tattap is not responsible for the quality, safety, or outcome of any tattoo services
- tattap is not liable for any injuries, infections, allergic reactions, or other health issues arising from tattoo services
- Users assume all risks associated with receiving tattoo services
- Artists are solely responsible for their work, health and safety compliance, and professional standards
All health, safety, consent, and legal requirements are handled directly between the user and the artist at the appointment. Users should verify that artists are properly licensed and insured before receiving services.
IN NO EVENT SHALL TATTAP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
9. Privacy and Data Use
By using tattap, you agree to our collection and use of your information as described in our Privacy Policy. We collect:
- Account information (email, display name)
- Location data (to show nearby artists)
- Booking history and preferences
We will never share your personal information with third parties except:
- With artists when you book appointments (name, contact info)
- As required by law
- With your explicit consent
10. Intellectual Property
- Users retain ownership of any content they upload (profile information, messages)
- Artists retain ownership of their flash designs and artwork
- By uploading content, you grant tattap a non-exclusive license to display it within the App
- You may not use tattap's name, logo, or branding without written permission
11. Prohibited Conduct
You may not:
- Use the App if you are under 18 years of age
- Provide false or misleading information
- Impersonate another person or entity
- Harass, threaten, or abuse other users or artists
- Use the App for any illegal purpose
- Attempt to interfere with or disrupt the App's functionality
- Upload viruses, malware, or other harmful code
Violation of these Terms may result in suspension or termination of your account.
12. Dispute Resolution
Governing Law
These Terms are governed by and construed in accordance with applicable state and federal laws where you access and use the App. Users and artists agree to comply with all local, state, and federal laws applicable to their location and use of the service.
User-Artist Disputes
tattap is not responsible for disputes between users and artists. Such disputes should be resolved directly between the parties.
Disputes with tattap
Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Massachusetts.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the App. Material changes will be communicated via email or in-app notification. Your continued use of tattap after changes are posted constitutes acceptance of the revised Terms.
The version number and effective date at the top of this document reflect the most current version.
14. Termination
We reserve the right to suspend or terminate your access to tattap at any time, with or without cause, with or without notice. Upon termination:
- Your right to use the App immediately ceases
- You remain bound by any obligations incurred before termination
- Provisions regarding liability, indemnification, and dispute resolution survive termination
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and tattap regarding your use of the App and supersede all prior agreements and understandings.
